1. About these terms
These terms apply to your use of this website and to sales by Masurians Sp. z o.o., Tracka 5, 10-364 Olsztyn, Poland (“we”). By using the site or placing an order you agree to them. Individual contracts may contain additional or different terms, which prevail where they conflict.
2. Products and information
We take care to describe our products accurately, but images, specifications, packaging and brands shown on the site are for illustration and may vary by batch, supplier and season. Please confirm the exact specification with us before ordering.
3. Enquiries and quotations
Product listings are not a binding offer. Prices are provided on request and are given in a written quotation, which states its validity period. A quotation does not become a contract until we confirm the order in writing or issue a proforma invoice and you accept it.
4. Orders and payment
Orders are accepted when confirmed by us in writing. Payment terms, such as bank transfer, advance payment or a letter of credit, are agreed per order and stated in the quotation or proforma invoice. We may postpone shipment until agreed payment has been received or secured.
5. Delivery and risk
Delivery terms follow the Incoterms® rule agreed in the order (for example EXW, FOB, CFR or CIF). Delivery dates are estimates and depend on suppliers, carriers, customs and weather. Risk passes to the buyer as set out in the agreed Incoterm.
6. Inspection and claims
The buyer should inspect goods on arrival. Any shortage, damage or non-conformity must be reported to us in writing with supporting photographs and batch details without delay, and in any case within the period set out in our Refund & Returns Policy.
7. Import, export and compliance
The buyer is responsible for import licences, permits, duties and taxes in the destination country unless the Incoterm provides otherwise. Both parties must comply with applicable trade, sanctions and anti-corruption laws. We may refuse or cancel an order where compliance cannot be assured.
8. Liability
Nothing in these terms limits liability that cannot be limited by law. Subject to that, our liability for any claim relating to an order is limited to the value of the goods concerned, and we are not liable for indirect or consequential loss.
9. Force majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disasters, strikes, port or border closures, war, pandemics, or government action.
10. Website use and intellectual property
The content of this website, including text, design and logos, belongs to us or our licensors. You may view it for your own business purposes but may not copy or reuse it without our permission.
11. Governing law
These terms are governed by Polish law. Disputes will be submitted to the courts with jurisdiction in Poland, without prejudice to any mandatory rights that consumers have under the law of their country of residence.
